1. Agreement to these terms

By accessing or using Tripanomics, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Who we are

Tripanomics is operated by Shard Software LLC, doing business as Tripanomics.

3. Service description

Tripanomics provides travel-planning tools, including generated itineraries, saved trips, share pages, maps, billing flows, and related support features.

Tripanomics is not a travel agency, tour operator, booking agent, transportation provider, emergency service, or professional advisor. Unless a third-party provider separately confirms a booking, reservation, or purchase, generated itinerary content does not create a booking or guarantee availability.

4. Eligibility and accounts

You must be at least 13 years old to use Tripanomics. If you are under the age of majority where you live, you may use the service only with permission from a parent or legal guardian. Paid purchases may be made only by users who can form a binding contract or by a parent or legal guardian on their behalf.

You must provide accurate account information, keep your login credentials secure, and use the service only for lawful purposes. You are responsible for activity that occurs through your account.

5. Electronic communications

By using Tripanomics, you agree to receive electronic communications from us related to your account, purchases, billing, support, security, and service changes. You may still opt out of non-essential promotional emails where we offer that option.

6. Generated and third-party information

Itineraries are generated from language-model output plus live and third-party enrichment data. They may be incomplete, stale, unavailable, mislabeled, hallucinated, or wrong. Travel conditions, hours, closures, availability, pricing, reservation rules, ticket requirements, transit schedules, weather, safety constraints, visa rules, neighborhood conditions, and accessibility details can change quickly.

You are responsible for verifying important details directly with the venue, airline, hotel, attraction, restaurant, tour operator, transportation provider, government authority, or other official source before you travel. You should not rely on Tripanomics as the sole source for time-sensitive, safety-sensitive, legal, immigration, medical, accessibility, reservation, pricing, or route information.

To the maximum extent permitted by law, we are not responsible for losses, costs, missed reservations, delays, cancellations, safety issues, or disappointment caused by reliance on itinerary suggestions, including arriving at a recommended place that is closed, unavailable, inaccessible, fully booked, unsafe, incorrectly described, or otherwise unsuitable.

7. Paid plans, credits, and cancellations

  • Paid subscriptions and one-time purchases are billed in advance.
  • Subscriptions renew automatically until you cancel them.
  • If you have an active Stripe customer record, you can manage cancellation and payment methods through the Stripe billing portal linked from Settings.
  • Refunds, credit reversals, or goodwill adjustments may be issued at our discretion, where required by law, or when we fail to deliver a paid service as described.
  • Used credits, completed itinerary generations, and third-party charges are generally not refundable unless required by law.
  • We do not provide refunds for travel costs, third-party bookings, transportation, lodging, event tickets, meals, or other expenses caused by relying on generated itinerary content.

8. Sharing and public links

If you enable itinerary sharing, the share page may be viewed by anyone with the link until you disable sharing. Do not publish information you do not want others to access.

9. User content and permissions

You retain any rights you have in trip inputs, notes, preferences, uploaded or submitted content, and itinerary content that you create or choose to save. You grant us a limited, worldwide, non-exclusive license to host, process, copy, display, transmit, format, and use that content as needed to operate, secure, support, improve, and provide the service, including generating itineraries, saving trips, rendering share pages you enable, and troubleshooting support or safety issues.

You represent that you have the rights needed to submit the content you provide and that your content does not violate another person's rights or applicable law.

10. Affiliate links and third-party services

Tripanomics may include affiliate links or links to third-party providers such as hotels, activities, maps, restaurants, attractions, event platforms, transportation providers, or booking platforms. We may receive a commission if you click or book through certain links. Third-party products, pricing, policies, availability, accessibility, safety practices, cancellations, refunds, and customer support are controlled by those providers, not by us.

You are responsible for reviewing and complying with each third party's terms, privacy policy, cancellation policy, refund policy, travel requirements, and safety instructions.

11. Acceptable use

You may not use the service to:

  • violate the law or another party's rights;
  • interfere with the service, security systems, or rate limits;
  • scrape, reverse engineer, or abuse the product beyond normal personal use;
  • use the service to advertise or offer goods or services unrelated to normal use of the product;
  • sell or otherwise transfer your account or profile; or
  • submit content that you do not have the right to use or share.

12. Intellectual property

The software, design, branding, and original product content of Tripanomics are owned by Shard Software LLC or its licensors. These Terms do not transfer ownership of that intellectual property to you.

13. Availability and changes

We may change, suspend, or discontinue parts of the service. We may also update pricing, plans, features, or these Terms when the product changes.

We do not guarantee uninterrupted availability, complete retrieval coverage, specific AI model behavior, particular itinerary results, or continued access to any third-party data source, map provider, enrichment provider, affiliate provider, or external service.

14. Suspension and termination

We may suspend or terminate access to the service if we reasonably believe you violated these Terms, created security or abuse risk, or used the service unlawfully. You may stop using the service at any time.

15. Updates to these terms

We may update these Terms from time to time. For material changes, we aim to post an updated version at least 30 days before the change takes effect. We may make immediate updates when needed for security updates, bug fixes, or court-ordered changes.

16. Governing law

These Terms are governed by the laws of the United States and the State of North Carolina, without regard to conflict-of-law principles.

17. Disputes and forum

To the extent permitted by law, disputes arising out of or relating to these Terms or the service must be brought in the state courts located in Wake County, North Carolina, or the federal courts serving North Carolina, and each party consents to that forum.

Any claim arising out of or relating to these Terms or the service must be brought within one year after the claim arises, unless applicable law requires a longer period.

18. Warranty disclaimer

The service is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, title, availability, reliability, completeness, currentness, and accuracy.

We do not warrant that generated itinerary content, maps, recommendations, affiliate links, or third-party information will meet your expectations, remain available, be safe or suitable for your circumstances, or be free from errors.

19. Limitation of liability

To the maximum extent allowed by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages; lost profits; lost data; lost goodwill; travel expenses; replacement travel costs; missed reservations; missed events; delay costs; cancellation costs; personal injury; property damage; emotional distress; or losses caused by relying on itinerary suggestions, generated output, third-party providers, travel-data providers, maps, affiliate links, or interrupted availability.

Our total liability for claims arising out of the paid service will not exceed the greater of the amount you paid us for the service giving rise to the claim during the 3 months before the event giving rise to liability or $100, unless applicable law requires a different limit.

20. Indemnification

You agree to indemnify and hold harmless Shard Software LLC from claims, damages, liabilities, and expenses arising from your misuse of the service, your violation of these Terms, or your violation of another person's rights.

21. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver of the right to enforce it later.

22. Assignment and force majeure

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the service.

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including internet or hosting outages, provider outages, payment processor outages, labor disputes, natural disasters, war, terrorism, government action, changes in law, or failures of third-party travel data and AI providers.
